NATIVIK — TERMS OF USE

Welcome to Nativik, a mobile application owned and operated by Labtriforce LTD, registered at Aigaiou, 83 Flat/Office 104, Lakatamia, 2302, Nicosia, Cyprus (“ we,” “ our,” or “ us”).
These Terms of Use (“Terms”) govern your access to and use of the Nativik mobile application (“ App”) and any related services.

By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use Nativik.

1. Purpose of the App

Nativik is an educational and entertainment app that helps children aged 3–10 learn English through play and interactive experiences.

The App is designed for children to use directly, but parents or legal guardians are responsible for account creation, management, and supervision.

2. Eligibility and Account Creation

  • Only parents or legal guardians may create an account on behalf of their child.
  • By creating an account, you confirm that you are the child’s parent or legal guardian and that you consent to your child’s use of Nativik.
  • Children may use the App only through accounts created and managed by their parents.
  • The App does not include chat, social interaction, or user-generated content.

3. Parental Responsibility

Parents or guardians are fully responsible for:

  • Supervising their child’s activity within the App.
  • Ensuring that the App is used in a safe and age-appropriate manner.
  • Managing subscription payments and account information.

We encourage parents to regularly monitor their child’s use of Nativik and discuss online safety with them.

4. Acceptable Use

You agree to use the App only for lawful, educational, and personal purposes.
You may not:

  • Attempt to reverse-engineer, copy, or modify the App.
  • Use the App in a way that disrupts its operation or interferes with other users.
  • Misuse the App or its content for commercial purposes without our written consent.

5. Intellectual Property

All intellectual property rights in the App, including text, graphics, illustrations, animations, sound, design, and code, belong to Labtriforce LTD or its licensors.

You are granted a limited, non-exclusive, non-transferable license to use Nativik solely for personal, non-commercial educational use.

You may not copy, distribute, or create derivative works from any part of Nativik.

6. Subscriptions and Payments

  • Access to Nativik may require a paid subscription.
  • Subscriptions are processed through Apple App Store, Google Play Store, or Stripe, depending on how you subscribed.
  • Refunds: All refund requests are handled by the respective app stores according to their refund policies.
  • There is no free trial available at this time.
  • You are responsible for all charges associated with your account.

Failure to pay subscription fees may result in suspension or termination of access.

7. Termination

You may cancel your subscription or stop using the App at any time.
We may suspend or terminate access to the App without notice if you violate these Terms or misuse the service.
Upon termination, your license to use the App ends immediately.

8. Disclaimers and Limitation of Liability

  • Educational Disclaimer: Nativik provides educational and entertainment content intended to support children’s English learning. It is not a substitute for formal education or professional teaching.
  • Parental Responsibility: Parents remain fully responsible for their child’s use of the App and for ensuring appropriate supervision.
  • No Warranty: Nativik is provided “as is.” We do not guarantee uninterrupted or error-free operation.
  • Limitation of Liability: To the maximum extent permitted by law, Labtriforce LTD and its affiliates shall not be liable for any direct, indirect, or incidental damages arising from your use of the App.

9. Updates to the App and Terms

We may update Nativik, change features, or modify these Terms from time to time.
We will notify users of any significant changes. Continued use of the App after such updates means you accept the revised Terms.

10. Governing Law and Jurisdiction

These Terms are governed by and interpreted under the laws of Cyprus.
Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Cyprus.
